Terms and Conditions (T&C) for the Rental of a Vacation Apartment
1. Scope
1.1 These General Terms and Conditions (hereinafter referred to as "T&C") govern the contractual relationship between the lessor and the lessee of a vacation apartment.
1.2 Deviating conditions of the lessee only apply if the lessor has expressly agreed to them in writing.
2. Booking and Conclusion of Contract
2.1 The booking of the vacation apartment is made by the lessee through a corresponding booking portal or directly through the website.
2.2 The contract only comes into effect upon confirmation through the website.
2.3 By concluding the contract, the lessee commits to paying the agreed rental price and adhering to these T&C.
3. Payment Conditions
3.1 The total rental price consists of the base price per night and potential additional services.
3.2 The lessee is obliged to pay the full amount immediately.
3.3 All payments are to be transferred to the lessor's specified account or directly to the booking portal.
3.4 If payment is not received by the due date, the lessor reserves the right to cancel the booking.
4. Cancellations and Changes
4.1 Cancellations must be made in writing. The date of receipt of the written declaration by the lessor is decisive for the cancellation.
4.2 Cancellations made up to 14 days before arrival will be fully refunded.
4.3 Cancellations made up to 7 days before arrival will receive a 50% refund.
4.4 No refunds will be provided for cancellations made later.
4.5 Changes to bookings are only possible after consultation with the lessor and subject to availability. Changes may incur rebooking fees.
5. Check-In and Check-Out
5.1 The vacation apartment is available to the lessee from 3:00 PM on the day of arrival.
5.2 On the day of departure, the apartment must be vacated by 11:00 AM at the latest.
5.3 The lessee is obliged to inform the lessor about the expected arrival time to ensure a smooth key handover.
6. Lessee's Responsibilities
6.1 The lessee is obliged to treat the vacation apartment carefully and leave it in proper condition.
6.2 The lessee is liable for damages caused by them or accompanying persons.
6.3 Smoking is not allowed in the vacation apartment.
6.4 Pets are not allowed to be brought along.
6.5 In case of violations, the lessor reserves the right to claim compensation of 300 euros.
7. Lessor's Liability
7.1 The lessor is not liable for damages caused by force majeure or unforeseeable events.
7.2 The lessor is not liable for any disruptions or failures of utility or telecommunications services.
8. Data Protection
8.1 The personal data provided by the lessee will be treated confidentially by the lessor and used only for the purpose of contract processing.
8.2 The lessor will not disclose the lessee's data to third parties unless necessary for contract fulfillment or legally required.
9. Severability Clause
9.1 If individual provisions of these T&C are or become invalid or partially invalid, the effectiveness of the remaining provisions shall remain unaffected.
10. Jurisdiction and Applicable Law
10.1 Disputes arising from or in connection with this contract are exclusively subject to the law of the Federal Republic of Germany.
10.2 The place of performance and exclusive place of jurisdiction is the domicile of the lessor, provided the lessee is a merchant or a legal entity under public law.
